Business & Finance 2023 LASA 2: Inappropriate Behavior

Marwan has worked at Studio Five Theme Park as a character actor portraying a swash buckling pirate He 2023

Marwan has worked at Studio Five Theme Park as a character actor portraying a swash-buckling pirate. He does not have an employment contract.  He loves his job because of his seniority with the company and all the attention he receives from the guests in the park. Unknown to anyone, his prosthetic leg has no noticeable impact on Marwan’s success in this position.

Marwan has become an accomplished flirt with all this attention, and now goes to the extent of placing his hands on the female guests’ behinds when posing for pictures. The women he has encountered so far have not complained, didn’t seem to mind, or they were taken by such surprise they were not sure how to respond.

One day, Marwan grabbed the breast of one of his fellow female actors who had been recently hired. When she threatened to report him, Marwan told her that he could get her fired if she did not go on a date with him. The fellow employee reported the incident anyway and Marwan was terminated immediately. Marwan contends that he was terminated as a result of physical disability.

Directions:

Research employment law related to hiring/firing and discrimination, using your textbook, the Argosy University online library resources, and the Internet. Based on the facts of the case and research, write an analytical paper. In the paper, respond to the following questions:

  • What civil rights laws may prohibit Marwan’s conduct with his fellow co-worker? Do those laws apply to his conduct toward the park guest?  Explain both answers.
  • Did Marwan commit sexual harassment? If so, what type? Explain your answers and the terms you use.
  • What is the legal nature of Marwan’s employment?  Explain your answers and the terms you use.
  • What actions and steps should Studio Five take against Marwan? Explain what actions you considered and why you either recommend them or reject them.
  • Discuss Marwan’s allegation that he is being discriminated against based on his disability and what response Studio Five may have to that allegation. What would each of them have to prove in court?
  • If the female employee sues Studio Five Theme Park, what defenses can Studio Five use?   Are they liable for Marwan’s conduct even if they were unaware of and did not approve of Marwan’s actions? Explain your answers and the terms you use.
  • If Marwan was a member of a union that had a collective bargaining agreement with Studio Five, would that change any of your previous answers? If so, why?
  • What types of company policies, procedures, and actions should businesses employ to avoid harassment of their employees?

Write a ten-page paper in Word format. Apply APA standards for writing style to your work.

anto-Regression analysis and its associated variables can be used for a wide range of business practices in industry. With the right formula, an analyst can utilize this tool in many ways. One way is to enhance the business process. An example of this would be a real-estate business using regression analysis to see what houses are being bought and what parts of the state or country these people are purchasing from. Another example would be a company seeing temperature used in an oven and the shelf life of food. In each of these examples, this type of analysis greatly helps business owners to make informed decision making.

What business leaders and managers need to use this for is to also strengthen any missing gaps in information on business planning and policy. With such relationships being able to be viewed, it allows a business owner to make larger profits and a higher number of competitive edges in the market. Of course, regression analysis still needs to be adjusted for a residual error rate and any other inaccurate measures performed during regression analysis.

michael-Regression analysis is critical in a business situation. Our author says “businesses and governments can use linear regression models to predict demand for goods and services” (EMC Education Services, 2015). I do think businesses should use statistical analysis to determine the right mix of components that affect sales performance. Regression analysis can help a business determine what to market, where to market and who to market to with the intention of increasing sales performance.

Cell phone manufacturers, such as Apple, have used statistical analysis to boost sales. Historically, cellphones were purchases as they were needed. Apple found that by financing their iPhones over the period of a year or two, customers would willing to send their old phones back to Apple and receive the latest model without affecting their monthly payment. This, in turn, increased iPhone sales for Apple.

“Regression analysis refers to a method of mathematically sorting out which variables may have an impact” (Teeboom, 2019). Statisticians often will show interest in multiple variables and regression analysis allows for analysis of the differences between those two variables. Depending on what type of research is taking place regression analysis can help determine which variables can be ignored, which variables are most important and how all of those variables interact with one another.

Chapter 8 – Information Governance and Legal Functions: According to the authors, Smallwood, Kahn, and Murphy, IG is perhaps one of the functional areas that impact legal functions most. Failure to meet them could be literally put an organization out of business or land executives in prison. Privacy, security, records management, information technology (IT), and business management functions are very important. However, the most significant aspect of all of these functions relates to legality and regulatory compliance from a critical perspective.

Q1: When we take a close look at the author’s point of view, under the Federal Rules of Civil Procedures (FRCP) amendments dating back to 1938 there has been governance and the discovery of evidence in lawsuits and other civil cases. Please name and briefly discuss the three (3) reasons why corporations must proactively manage the e-discovery process?

Chapter 9 – Information Governance (IG) and Records and Information Management Functions. From the Chapter, we have learned from that Records Management (RM) is a key impact area of IG – so much that in the RM space, IG is often thought of as synonymous with or a single superset of RM. From that perspective, the International Organization for Standardization (ISO) defined business records as “information created, received, and maintained as evidence and information by an organization or person, in pursuance of legal obligations or in the transaction in the form of records.”

Q2: To further enhance our knowledge and understanding of RM, ISO provided a more refined definition of RM to a granular level as “[the] field of management responsible for the efficient and systematic control of what…? Identify and complete the missing phrase to directly complete the granular definition?
